1. Acceptance of Terms

Welcome to TOVRINO (“TOVRINO,” “we,” “our,” or “us”).

These Terms & Conditions (“Terms”) govern your access to and use of the TOVRINO Website and your communications and interactions with TOVRINO in connection with our marketing, lead-generation, scheduling, customer-support, and referral services.

By using our Website, submitting a service request, requesting an estimate, requesting or scheduling an appointment, communicating with TOVRINO, or affirmatively accepting these Terms where an acceptance option is presented, you acknowledge that you have had an opportunity to review these Terms and agree to be bound by them.

If you do not agree with these Terms, please do not use our Website or scheduling and referral services.


2. TOVRINO’s Role

TOVRINO is a marketing, lead-generation, scheduling, customer-support, and referral company.

TOVRINO helps customers request and schedule Air Duct Cleaning and Dryer Vent Cleaning appointments with independently owned and operated third-party service providers (“Service Providers”).

TOVRINO does not employ field technicians and does not perform field services at customer properties.

TOVRINO does not itself undertake, bid for, contract to perform, or perform HVAC contracting, construction, repairs, replacements, installations, mold assessment or remediation, electrical work, plumbing work, or other field work requiring professional licensing or governmental authorization.

TOVRINO’s role is limited to activities such as marketing, receiving customer requests, communicating with customers, coordinating appointments, providing customer support, and connecting customers with independent Service Providers.

Scheduling an appointment through TOVRINO does not mean that TOVRINO has agreed to perform the field service.


3. Independent Service Providers

Field services arranged through TOVRINO are performed by independently owned and operated Service Providers.

Service Providers are separate businesses and are not employees, agents, partners, joint venturers, franchisees, or legal representatives of TOVRINO.

TOVRINO does not control a Service Provider’s day-to-day field operations, personnel, professional judgment, service methods, means, tools, equipment, recommendations, pricing decisions, or manner of performing field services.

Service Providers do not have authority to make contracts, warranties, guarantees, promises, representations, or commitments on behalf of TOVRINO unless TOVRINO expressly authorizes such authority in writing.

Any agreement concerning the actual performance of field services, including field-service scope, pricing, payment, workmanship, warranties, guarantees, refunds, and service results, is between the customer and the independent Service Provider performing those services.


4. Appointment and Referral Model

A request, lead, referral, advertisement, telephone call, estimate request, or appointment generated or coordinated through TOVRINO is intended to help connect a customer with an independent Service Provider.

The appointment itself does not create a contract for TOVRINO to perform field work.

The Service Provider is independently responsible for discussing with the customer any proposed field service, final scope, final price, required customer authorization, and any terms applicable to the field service before performing work.

If the customer accepts a Service Provider’s proposed work, the resulting field-service transaction is between the customer and that Service Provider.


5. Licensing and Regulated Work

Each Service Provider is independently responsible for determining and complying with any licensing, certification, registration, permitting, insurance, or other legal requirements applicable to the field services it offers or performs.

A Service Provider must not perform work requiring professional authorization unless the person or entity performing that work is legally authorized to do so.

TOVRINO does not lend, provide, sponsor, transfer, or authorize the use of any contractor or professional license.

Nothing in a TOVRINO advertisement, customer communication, referral, or appointment authorizes TOVRINO or any Service Provider to perform regulated work in violation of applicable law.

If a Service Provider determines that requested or recommended work requires a license, permit, certification, registration, or other professional authorization, responsibility for legally addressing that proposed work remains with the Service Provider and the customer involved in that field-service transaction.


6. Service Provider Responsibilities

Each Service Provider is independently responsible for the field services it provides, including, as applicable:

Its personnel and subcontractors;

On-site evaluations and professional judgment;

Descriptions and explanations of proposed services;

Final scope of work;

Final pricing;

Customer authorization;

Workmanship and service quality;

Tools, equipment, and materials;

Safety practices;

Compliance with applicable laws;

Required licenses, certifications, permits, registrations, and insurance;

Collection of customer payment;

Invoices and receipts;

Any warranty or guarantee offered by the Service Provider;

Refunds or adjustments relating to the Service Provider’s work; and

Conduct at the customer’s property.

TOVRINO does not assume these field-service responsibilities merely because it advertised a service category, received a customer request, coordinated an appointment, or later assisted with customer communication.


7. Estimates, Advertised Prices and Promotions

Prices, discounts, coupons, or promotional amounts displayed in TOVRINO advertising may represent introductory, starting, estimated, or promotional pricing applicable under stated or standard conditions.

Unless expressly stated otherwise, an advertised or estimated price is not a guarantee of the final price for field services ultimately offered or performed by an independent Service Provider.

A Service Provider may review the requested service and property conditions and determine whether the customer’s request falls within the advertised or estimated scope.

Before performing additional or differently priced work, the Service Provider is responsible for explaining the proposed service and price to the customer and obtaining the customer’s authorization.

Customers are free to accept or decline additional services.

TOVRINO does not authorize deceptive, misleading, fraudulent, coercive, unfair, or unlawful sales practices.


8. Customer Authorization and Final Pricing

Customers should review and understand the Service Provider’s proposed scope and final price before authorizing field work.

A customer is not required by TOVRINO to purchase additional services recommended by a Service Provider.

Authorization for work beyond the originally requested service should be obtained directly by the Service Provider before that additional work is performed.

Questions concerning a Service Provider’s final price, additional work, warranty, or payment terms should be addressed directly with the Service Provider before authorization.


9. Additional Services Proposed by a Service Provider

TOVRINO coordinates appointments based on the service request submitted by the customer.

A Service Provider may independently identify or propose additional services after arriving at the customer’s property.

Any additional service independently proposed by a Service Provider, including equipment installation, repair, replacement, UV or air-purification equipment, mold-related services, HVAC work, electrical work, or other work beyond the customer’s original TOVRINO service request, is not offered, sold, contracted for, approved, supervised, performed, or guaranteed by TOVRINO merely because the original customer appointment was generated or scheduled through TOVRINO.

If a Service Provider independently proposes additional work, that Service Provider is responsible for determining whether the proposed work requires licensing, certification, registration, permitting, insurance, or other legal authorization and for complying with all applicable requirements.

Any agreement between a customer and a Service Provider concerning independently proposed additional work, including its scope, price, authorization, payment, performance, warranty, or refund terms, is between the customer and that Service Provider.

TOVRINO does not authorize a Service Provider to use a TOVRINO appointment, lead, referral, advertisement, or customer relationship as authority to perform work that the Service Provider is not legally authorized to perform.

TOVRINO does not authorize Service Providers to represent that TOVRINO requested, approved, recommended, guaranteed, or required additional work when TOVRINO did not do so.


10. Payments

TOVRINO does not collect or process customer payment for field services.

TOVRINO does not determine a Service Provider’s final price.

TOVRINO does not issue the Service Provider’s field-service invoice or receipt.

Payment for field services is handled directly between the customer and the independent Service Provider performing the services.

The Service Provider is responsible for collecting payment and providing its own invoice, receipt, or other applicable transaction documentation.

TOVRINO may separately receive compensation from Service Providers for marketing, lead-generation, scheduling, referral, customer-support, or other legitimate business services.

Any such compensation is separate from the customer’s payment to the Service Provider for field services and does not make TOVRINO the contractor, employer, agent, partner, or supervisor of the Service Provider.


11. No Technical Advice or Diagnosis by TOVRINO

TOVRINO communications with customers are primarily for marketing, scheduling, referral, appointment coordination, and customer-support purposes.

TOVRINO does not perform on-site inspections and does not provide professional HVAC diagnoses, engineering advice, mold assessments, technical evaluations, or professional opinions concerning the condition of a customer’s equipment or property.

Information a customer provides to TOVRINO concerning symptoms, property conditions, equipment, vents, ducts, or requested cleaning services may be used to understand the customer’s request and coordinate an appointment.

Any on-site technical evaluation, professional recommendation, service recommendation, or diagnosis is the responsibility of the independent Service Provider providing that evaluation or recommendation.


12. No Guarantee of Service Provider Performance

TOVRINO does not guarantee the workmanship, professional judgment, recommendations, representations, availability, arrival time, completion time, final pricing, warranties, guarantees, or results of an independent Service Provider.

Each Service Provider remains independently responsible for the services it performs and for maintaining any license, permit, certification, registration, insurance, or other authorization required for its activities.

Property conditions, accessibility, system conditions, maintenance history, construction, environmental conditions, and other circumstances may affect the services offered or results achieved by a Service Provider.

Nothing in these Terms limits responsibility that TOVRINO may have for its own conduct where applicable law does not permit that responsibility to be waived or limited.


13. Service Provider Conduct

TOVRINO does not authorize deceptive, fraudulent, coercive, unsafe, unauthorized, unlicensed, or otherwise unlawful conduct by a Service Provider.

A Service Provider may not represent itself as a TOVRINO employee or field technician when it is not one.

A Service Provider may not represent that TOVRINO performed, supervised, warranted, or guaranteed the Service Provider’s field work when TOVRINO did not do so.

TOVRINO may choose not to coordinate future appointments with a Service Provider based on legitimate business, customer-service, safety, fraud-prevention, compliance, or quality concerns.

Such a decision does not mean TOVRINO controlled or supervised the Service Provider’s prior field work.


14. Customer Follow-Up and Customer Support

TOVRINO may contact customers before or after an appointment for scheduling, appointment confirmation, customer support, quality assurance, fraud prevention, complaint handling, dispute communication, or customer feedback.

TOVRINO may ask whether a Service Provider arrived, whether the requested service occurred, whether additional work was proposed, whether a problem occurred, or whether the customer was satisfied.

Customer follow-up, complaint handling, or customer-support assistance by TOVRINO does not constitute supervision or control of the Service Provider’s field operations.

TOVRINO may voluntarily assist a customer and Service Provider in communicating about a concern.

Providing such assistance does not mean TOVRINO assumes responsibility for the Service Provider’s work, promises a particular outcome, or becomes a party to the Service Provider’s field-service transaction.


15. Complaints, Property Damage and Field-Service Disputes

Complaints concerning workmanship, field-service pricing, warranties, refunds, billing, property damage, bodily injury, incomplete work, service results, or other matters arising from services performed by an independent Service Provider should be directed to the Service Provider responsible for the field service.

TOVRINO may assist with communication at its discretion but does not thereby assume responsibility for the Service Provider’s field work or conduct.

Nothing in this section limits any non-waivable right or remedy available to a customer under applicable law.


16. Communications and Appointment Information

When you voluntarily submit your contact information or request assistance scheduling a service, you authorize TOVRINO to use information reasonably necessary to respond to and coordinate your request.

TOVRINO may share relevant contact, property, requested-service, and appointment information with an independent Service Provider where reasonably necessary to coordinate the requested appointment.

The Service Provider may contact the customer concerning the appointment and requested service.

Marketing communications will be sent only as permitted by applicable law and subject to legally required consent and opt-out rights.

17. Telephone Calls and Call Recording

TOVRINO may use telephone communications for scheduling, customer support, quality assurance, training, fraud prevention, security, recordkeeping, and dispute resolution.

If a call is monitored or recorded, TOVRINO will provide or obtain any notice or consent required by applicable law before or at the time required by law.

The presence of a call-recording provision in these Terms does not eliminate any separate notice or consent requirement imposed by applicable law.


18. Website and Advertising Information

TOVRINO seeks to keep its Website and advertising reasonably accurate and current but does not guarantee that all content, pricing, promotions, appointment availability, or other information will always be complete, error-free, or current.

Promotional offers may be subject to conditions, limitations, availability, property characteristics, requested scope, or other disclosed factors.

Nothing on TOVRINO’s Website, in an advertisement, or in a scheduling communication should be interpreted as an undertaking by TOVRINO to perform licensed contracting or regulated field work.

TOVRINO does not authorize any person to rely on its advertising as permission to perform work in violation of licensing, permitting, consumer-protection, or other applicable laws.


19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TOVRINO IS NOT RESPONSIBLE OR LIABLE FOR THE INDEPENDENT ACTS OR OMISSIONS OF AN INDEPENDENT SERVICE PROVIDER.

THIS INCLUDES, TO THE FULLEST EXTENT PERMITTED BY LAW, CLAIMS ARISING FROM OR RELATING TO A SERVICE PROVIDER’S WORKMANSHIP, NEGLIGENCE, PROFESSIONAL JUDGMENT, RECOMMENDATIONS, REPRESENTATIONS, FINAL PRICING, UNAUTHORIZED OR ADDITIONAL WORK, DELAYS, FAILURE TO COMPLETE WORK, LICENSING, CERTIFICATION OR PERMITTING VIOLATIONS, BILLING PRACTICES, WARRANTIES, GUARANTEES, PROPERTY DAMAGE, BODILY INJURY, SAFETY PRACTICES, INSTALLATIONS, REPAIRS, REPLACEMENTS, EQUIPMENT SOLD OR INSTALLED BY THE SERVICE PROVIDER, OR OTHER INDEPENDENT FIELD-SERVICE CONDUCT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TOVRINO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE USE OF TOVRINO’S WEBSITE OR TOVRINO’S OWN MARKETING, LEAD-GENERATION, SCHEDULING, CUSTOMER-SUPPORT, OR REFERRAL SERVICES.

Nothing in these Terms excludes, waives, or limits liability that applicable law does not permit to be excluded, waived, or limited, including responsibility arising from TOVRINO’s own conduct to the extent applicable law makes such responsibility non-waivable.


20. No Waiver of Consumer Rights

Nothing in these Terms is intended to waive any consumer right or remedy that applicable federal, Florida, or other mandatory law does not permit a consumer to waive.

If a provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement controls to the extent of that conflict.


21. No Employment, Partnership, Joint Venture or Agency

Nothing in these Terms creates an employment relationship, partnership, franchise, joint venture, agency, fiduciary relationship, or similar relationship between TOVRINO and an independent Service Provider.

No Service Provider has authority to bind TOVRINO, enter into an agreement on TOVRINO’s behalf, assume an obligation for TOVRINO, or make a warranty or guarantee on TOVRINO’s behalf unless expressly authorized in writing by TOVRINO.

Likewise, TOVRINO’s scheduling or referral of a Service Provider does not by itself make that Service Provider an agent or employee of TOVRINO.


22. Governing Law and Venue

These Terms are governed by applicable federal law and the laws of the State of Florida, without regard to conflict-of-law principles, except where another mandatory law applies.

To the extent permitted by applicable law, any court proceeding arising directly from TOVRINO’s own Website, marketing, scheduling, lead-generation, customer-support, or referral services shall be brought in a court of competent jurisdiction in Orange County, Florida.

This section does not govern a separate dispute solely between a customer and an independent Service Provider concerning that Service Provider’s field services unless applicable law provides otherwise.


23. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary to make it enforceable where permitted by law.

The remaining provisions shall continue in full force and effect.


24. Changes to These Terms

TOVRINO may update these Terms from time to time to reflect changes in its Website, business operations, legal requirements, or practices.

Changes apply prospectively from the time updated Terms are posted or otherwise become effective, except where applicable law requires different treatment.

The Last Updated date at the top of these Terms may be revised when material changes are made.
